3.2. Aggregated News Content and Fair Use

Abpanelpc is a news aggregation service. We do not create the original news content displayed on our Service. Instead, we aggregate, curate, and display headlines, summaries, excerpts, and links (“Aggregated Content”) from third-party news sources.

We believe our use of this third-party content constitutes a “fair use” under Section 107 of the U.S. Copyright Act and similar doctrines in other jurisdictions. This fair use is based on the transformative nature of our aggregation service, which provides a new utility by collecting and organizing diverse news sources into a single, accessible platform. Our use is non-commercial in nature and does not negatively impact the potential market for or value of the original works.

We provide clear and prominent attribution to the original source for all Aggregated Content, including the source name and a direct link to the original article. We do not claim ownership of the Aggregated Content. All copyrights, trademarks, and other intellectual property rights in the original news articles remain with their respective owners.

4. User-Submitted Content

The Service may allow users to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“User Content”). You are solely responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting User Content on the Service, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

We reserve the right to remove any User Content at any time and for any reason, without prior notice. We do not pre-screen User Content, and we are not responsible for the accuracy, completeness, or usefulness of any User Content. All User Content expresses the views of the author, and Abpanelpc expressly disclaims any liability relating to User Content.

5. Third-Party Links and Content

Our Service contains links to third-party websites or services that are not owned or controlled by Abpanelpc. These links are provided solely as a convenience to you.

Abpanelpc has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Abpanelpc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We do not guarantee the accuracy, completeness, or usefulness of any third-party content, including the news articles we aggregate. The inclusion of any link does not imply endorsement by Abpanelpc of the site or any association with its operators. You access and use such third-party content entirely at your own risk.

6. Copyright Policy and DMCA Safe Harbor

Abpanelpc respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property rights of any person.

In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), the text of which may be found on the U.S. Copyright Office website, Abpanelpc will respond expeditiously to claims of copyright infringement committed using the Service that are reported to our designated Copyright Agent, identified below.

We qualify for the safe harbor from copyright infringement liability provided by 17 U.S.C. § 512(d). Our role is that of an intermediary, and we do not host the infringing content itself, but rather provide hyperlinks to content hosted on third-party sites.

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ABPANELPC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, or (iv) the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.

Any content downloaded or otherwise obtained through the use of the Service is downloaded at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from such download.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABPANELPC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT OF FIFTY US DOLLARS ($50.00 USD).

9. Indemnification

You agree to defend, indemnify, and hold harmless Abpanelpc and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. 11. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.
